In short
- We process the data you give us when you contact us, sign up for a course, apply for a job or work with us, as well as technical data from visits to the website. To offer our services to businesses, we also use business contact details that are publicly available.
- We use this data to reply to you, to run our courses, to work with our clients and to offer our services. We do not sell it. We only send mailings with news and offers if you have agreed to receive them or are already a client, and you can tell us at any time to stop contacting you.
- The public pages of the website do not use cookies, analytics tools or advertising tools.
- The website's server is in Germany and our email is in the European Union; some providers may process data in the United States, with the safeguards required by law. To see, correct or delete your data, write to info@digitam.ch.
This policy applies to the digitam.ch website, the Client area and any contact with us (forms, email, phone, WhatsApp, courses and job applications). It is based on the Swiss Federal Act on Data Protection (FADP) and, where it applies, the European Union's General Data Protection Regulation (GDPR).
1. Who is responsible for your data
The controller is:
Digitam Sagl
Via dei Portici 16, 6809 Medeglia (Municipality of Monteceneri), Switzerland
UID CHE-346.492.201
Email: info@digitam.ch
Phone: +41 91 946 16 11
If you have any questions about your data, write to us at info@digitam.ch.
2. When you visit the website
When you open a page, the server that hosts the website automatically records some technical data: IP address, date and time, the page requested, the referring page, and the browser and device you are using. We need this data to show you the pages, for security and to detect errors or misuse. We do not use it to find out who you are, except in cases of misuse.
At present, the website does not use any analytics or advertising tools, and the public pages do not use cookies. If in future we use analytics tools that rely on cookies, we will only do so with your consent and we will update this page. You will find the details in the Cookie Policy.
3. When you contact us
You can write to us through the website's forms (for example to request a consultation, get in touch, ask for a quote or a demo, get the free guide or propose a course), by email, by phone or on WhatsApp. Depending on the case, we process:
- your first and last name (optional for the free guide);
- your email address;
- your phone number, if you provide it;
- your company name, which is always optional;
- your message and the answers you give in the form, for example the topics you are interested in, your indicative budget, your current website or how you heard about us;
- the page you are writing from, the language, the date and time, and your IP address, which we use to stop automated submissions and misuse.
The required fields are marked in the form: without that data we cannot reply to you.
We use this data to reply to you and to prepare the consultation, quote or demo you ask for. Requests sent through the forms are saved in the website's database and in our CRM (the software we use to keep track of our contacts), and you receive a confirmation email.
If you write to us on WhatsApp or on social media (LinkedIn, Instagram, TikTok), your message passes through that service, which processes it under its own rules. WhatsApp is part of the Meta group and also has servers in the United States. If you prefer, write to us by email.
4. Courses
To sign up for a course, you give us your name and email address and, if you wish, your phone number, company and any notes; you also choose the session. As with the forms, we also save the date, time and IP address to prevent misuse. We use this data to organise the course, to send you the confirmation, the materials and access to the participants' area and, for paid courses, to invoice you.
- If you pay, your payment details are processed by your bank or by the payment provider used.
- If we organise the course with a partner, we give the partner the names of the participants.
- Online courses take place on a third-party video conferencing platform, which processes data under its own terms.
- Some courses are booked on the organiser's website: in that case, the organiser's privacy policy also applies, and the organiser passes on to us the data needed for the course.
5. Clients and the Client area
If you become a client, we process the data we need for our work together: names and contact details of the contact persons, quotes, contracts, invoices, payments and communications about the project.
The Client area (clienti.digitam.ch) is our private platform. You need a personal account to log in: we process your account data and the documents and materials we share with you. The Client area uses technical cookies to keep you logged in.
When we process data on behalf of a client, for example in an automation we build for them, the contract with that client and the client's own privacy policy apply.
6. Job applications
Job applications reach us by email at info@digitam.ch. We use your CV, cover letter and any other data you send us only for the selection process. If you would like us to keep your application for future positions, let us know that you agree.
7. Contacting businesses and sending news
We may contact a business to present our services. To do so, we use business contact details (name, job title, business email address and phone number) taken from public sources, such as the commercial register and the company's website, and we record them in our CRM.
You only receive mailings with news and offers if you have agreed to receive them. If you are already a client, you receive them for services similar to the ones you have bought from us. Every one of these emails tells you how to unsubscribe. You can also tell us at any time to stop contacting you: just send an email to info@digitam.ch.
8. Who receives your data
We do not sell your data. Within Digitam, only the people who handle it can see it. Outside Digitam, it is received by:
- providers that work on our behalf, only on our instructions: the company that hosts the website's server and database, the service that sends the website's automated emails, our email provider, our CRM and other IT, productivity and artificial intelligence (AI) tools;
- the partners with whom we organise a course, who receive the names of the participants;
- for courses, the bank or payment provider and the video conferencing platform;
- the service you use, if you write to us on WhatsApp or social media;
- the authorities, if the law requires us to, and our lawyers or a court, where needed to defend our rights.
9. Data outside Switzerland
Some data is processed outside Switzerland:
- the server that hosts the website, its database and the Client area is in Germany;
- the website's automated emails are sent from servers in Ireland;
- our email is hosted on servers in the European Union.
The Swiss Federal Council considers that the member states of the European Union provide an adequate level of data protection.
Some providers may also process data in the United States, where they are based or have servers: the service that sends the website's automated emails and some IT, productivity and AI tools. The same applies to WhatsApp. In these cases we rely on one of the following safeguards: the provider's certification under the Swiss-U.S. Data Privacy Framework (and the EU-U.S. Data Privacy Framework), or standard contractual clauses, which are model contracts approved by the Federal Data Protection and Information Commissioner (FDPIC) and the European Commission. On request, we will give you a copy of these safeguards.
10. How long we keep your data
We keep data only for as long as we need it, and then we delete or anonymise it:
- enquiries and contacts that do not lead to a client relationship, including contacts taken from public sources: no more than 12 months after the last contact;
- if you ask us to stop contacting you: we keep only the data needed to respect your request (for example your email address and company name) on a do-not-contact list;
- client data: for the whole duration of our relationship and then for the periods required by law, in particular 10 years for invoices and other accounting records (Art. 958f of the Swiss Code of Obligations);
- course registrations: for organising the course and no more than 12 months after it ends; for paid courses, the accounting records are kept for 10 years;
- job applications: until the end of the selection process and then no more than 6 months, unless you agree that we keep them for future positions;
- technical server logs: they are needed for the security and operation of the website and are overwritten automatically when the space reserved for them is full;
- server backups: for a limited period, after which they are overwritten.
11. Security
We protect data with appropriate technical and organisational measures. The website uses an encrypted connection (HTTPS), the database cannot be reached from the internet, and the website's management area is protected by a password and a limit on login attempts.
12. Your rights
At any time, you can ask us:
- to tell you what data we hold about you and to give you a copy;
- to correct it if it is wrong or incomplete;
- to delete it, unless the law requires or allows us to keep it;
- to stop using it for a particular purpose, for example to contact you;
- to give you the data you provided to us in a commonly used electronic format, or to transfer it to another organisation, under the conditions set by law.
If you have given us your consent, you can withdraw it at any time, with effect for the future.
Write to us at info@digitam.ch: we normally reply within 30 days, free of charge. To protect your data, we may ask you to prove your identity.
We do not make decisions based solely on automated processing that have legal effects or other significant effects on you.
If you think we are not complying with the law, you can contact the Federal Data Protection and Information Commissioner (FDPIC): www.edoeb.admin.ch.
13. If you are in the European Union
If you are in the European Union or the European Economic Area (for example in Liechtenstein) and the GDPR applies to your data, the rules in this section also apply. We process your data on the following legal bases (Art. 6(1) GDPR):
- contract (point (b)): what you ask us for before a contract (consultation, quote, demo, free guide), course registrations, job applications and contracts with you;
- legitimate interests (point (f)), namely our interest in protecting the website (technical logs), replying to people who write to us, working with the contact persons at our client companies, making our services known (contacting businesses, and sending clients news and offers about similar services), complying with Swiss law (accounting, requests from authorities) and defending our rights;
- consent (point (a)): news and offers to people who are not clients, and keeping a job application for future positions.
In addition to the rights listed in section 12, you can ask us to restrict the processing of your data.
Right to object. You can object at any time to the use of your data for direct marketing, including when we contact you to offer our services: from that moment, we stop. You can also object to other processing based on our legitimate interests, on grounds relating to your particular situation. Just send an email to info@digitam.ch.
You can lodge a complaint with the supervisory authority of the country where you live or work or where the alleged infringement took place. In Italy, this is the Garante per la protezione dei dati personali, the Italian data protection authority (www.garanteprivacy.it).
The European Commission recognises that Switzerland provides an adequate level of data protection.
14. Changes
We update this policy when our processing, our providers or the law change. The version published on this page, with the date at the top, is the one that applies. This page is also available in Italian: in case of any difference, the Italian version prevails.
